Texas Non-Custodial Parents Rights
For more information, contact the best Austin Divorce attorney…The word custody is often used to refer to the control and responsibility for a minor child, and applies in situations where the parents are not living together. The parent with custody is the one that lives with the child while the non-custodial parent is often the person paying child support, and has visitation rights. Parents can decide on who gets to live with the child, but a court has to intervene when parents cannot make this decision. The court works with both parents to agree about primary physical custody and a visitation schedule.
Non-custodial parents should know their rights, because there have been times when custodial parents deny visitation to non-custodial parents. If you are the custodial parent, you should know that you cannot just decide to stop the other parent from having any contact with a child. To know what options you have, you should contact an attorney for information about your rights as a parent.
Court’s Role In Determining Visitation and Custody

Your attorney will listen to your goals as far as child custody is concerned and create a strategy that can help you win your case. Most Texans choose not to go to a formal trial to decide on child support and instead choose to negotiate. But if you do end up in court, it is important that you provide evidence that proves that you are fit and stable and are able to provide a safe and loving environment for their child. Even in situations where the custody case is decided out of court, you will need a lawyer to help you make a decision that will not rob you of your parental rights.

You need legal advice if you are in a situation where you need to protect your child from an unfit or unstable non-custodial parent. Custodial parents have to go to court and present evidence that the other parent is unstable and unfit to have visitation rights. The evidence must show that the non-custodial parent is dangerous, erratic or irresponsible. However, the non-custodial parent can challenge any attempt by a custodial parent to deny visitation rights.
